Attorney General Cases

n this state and more specifically El Paso County, the Texas Attorney General will initiate legal action in the Title IV-D Court for the purpose of collection and/or enforcement of child support. Oftentimes, the custodial parent of the child will request the Attorney General to initiate legal action in order to collect and/or enforce child support or the Attorney General on its own will initiate legal action to collect and/or enforce child support if the parent who has actual custody of the child receives government assistance from the state. Also, the Attorney General will initiate legal action in the form of a modification in which they request the previous order of the Court be modified and the noncustodial parent's child support obligation be increased.

In all of the above instances, the parent or party against whom the legal action is being sought may need legal representation in order to ensure their rights and interests are protected and they are not taken advantage of by the Office of the Attorney General.

When the parents of a child are unmarried and the child resides with the mother, the Attorney General can initiate a legal action against the alleged father in order to establish his paternity. The Attorney General's sole purpose in establishing a father's paternity is so that they can collect child support for the mother. However, in establishing the paternity/parentage of a father, the Court order rendered not only sets out the father's child support obligation but also necessarily includes orders governing the custody of the child, rights and duties of the parents, visitation rights and other orders pertaining to the best interest of the child. In these cases, it is important for the alleged father to have his own legal representation in order to ensure once again that his rights and interests are protected and that he is not taken advantage of by the Office of the Attorney General.
